1. The service

BizKick lets you build a forecast financial plan (income statement, cash flow, balance sheet, simulated Belgian taxation). Basic use is free. The paid plans unlock additional features (PDF report export, management of several files, etc.), described on the service's “Pricing” page.

2. Nature of the results — essential clause

BizKick's simulations are indicative. They are based on the assumptions you enter and on simplified tax and social security parameters that may change. They are neither accounting, tax, legal or financial advice, nor a guarantee of results. Have your plan reviewed by an accountant (ITAA) before any decision, company incorporation or loan application.

3. Plans, prices and payment

BizKick offers a free plan and paid plans (one-time purchase and subscriptions), described on the service's “Pricing” page. The prices shown there include VAT unless stated otherwise (subscriptions are shown excluding VAT) and may change; the applicable price is the one in force at the time of subscription. For current subscriptions, any price change is notified at least 30 days before it takes effect; the user may cancel the subscription before that date, the change applying only from the next renewal. Payment is handled by our payment provider, invoicing by our invoicing provider; BizKick stores no bank card data.

Each purchase is confirmed to you by email: the product, the amount, the date, and the text you accepted on the payment page. Your invoice is sent to you separately.

4. Subscriptions

The Starter and Pro plans are subscriptions, monthly or annual; the annual subscription is billed for eleven months. The price of each period is paid in advance, at its start.

Term and renewal. The subscription is concluded for the chosen period (one month or one year) and renews automatically for the same period unless cancelled.
Cancellation. You may cancel at any time in the application (“Manage my subscription”). Cancellation takes effect at the end of the current period; the period already started is not refunded, subject to the right of withdrawal (Article 6) and the legal guarantee of conformity (Article 7). Changing plans is done in the same place.
Non-payment. If a payment fails, access is maintained during our payment provider's reminders; failing payment, the subscription ends.
Effects of the end of the subscription. The account returns to the free plan. Your files are kept and remain accessible; creating new files is limited to the free plan's ceiling, as is sending new invitations. The features specific to the plan (export, valuation…) stop, except for files unlocked by a one-time purchase (Article 5).
The “Custom” plan is governed by a separate contract.

5. One-time purchase

The one-time purchase (price including VAT) unlocks the export of one file: the file for which it is bought.

Locked identity. On purchase, the file's name, sector and description are locked: they can no longer be changed, either in the application or in the exported documents. The rest of the file (figures, assumptions) can still be changed.
Correction. A typo in the name, or a change of name decided before the company is incorporated, may be corrected on a reasoned request sent to contact@bizkick.be, for the same project. Another project requires a new purchase.
Tied to the file. The unlock cannot be transferred: a copy of an unlocked file is created locked (it keeps your export choices), and deleting an unlocked file loses its unlock, without refund.
Duration. The unlock lasts for the life of the file. It does not depend on any subscription and remains if you take out or cancel one.

6. Right of withdrawal

A consumer in principle has 14 days to withdraw from a distance contract, without giving any reason.

One-time purchase. The unlock is digital content supplied upon payment. When purchasing, you expressly request its immediate performance and acknowledge that you thereby lose your right of withdrawal (Article VI.53, 13°, of the Belgian Code of Economic Law).
Subscriptions. The subscription is a service. When subscribing, you request that it start upon payment, without waiting for the end of the withdrawal period. You keep your right of withdrawal for 14 days from subscription; if you exercise it, you remain liable for an amount proportional to the service provided up to your withdrawal (Article VI.51, § 3, of the Belgian Code of Economic Law), and the balance is refunded to you.
The request and its proof. It is collected, for each purchase, by a checkbox that is not pre-ticked on the payment page, below the text that describes it, and then confirmed by email (Article 3).
Exercising your right. Send us an unambiguous statement before the end of the period, to contact@bizkick.be; you may use the model withdrawal form (Annex 2 to Book VI of the Belgian Code of Economic Law), but you are not obliged to. The refund is made no later than 14 days after we receive your withdrawal, using the means of payment you used.

This right does not apply to business customers (B2B). If a technical problem prevents you from using the paid service, contact contact@bizkick.be: we fix it or refund you.

7. Legal guarantee of conformity

If you are a consumer, the digital content and digital services supplied by BizKick benefit from the legal guarantee of conformity provided by the Belgian Civil Code for the supply of digital content and digital services. Report a lack of conformity to contact@bizkick.be: we fix it, and failing that, you are entitled to a price reduction or to terminate the contract, under the conditions laid down by law. This guarantee is in addition to these terms; none of their clauses limits it.

8. Intellectual property in the service

The website, the application, its calculation engine, interface, texts, logo and the name “BizKick” are the exclusive property of the publisher and are protected by copyright, trademark law and, where applicable, the sui generis database right. The following are prohibited without prior written authorisation: copying, reproduction, substantial extraction, decompilation, reverse engineering, automated “scraping” of the service, and any use aimed at developing a competing product or service. Any infringement exposes its author to civil and criminal proceedings.

9. Your content

Your files belong to you. You grant us only the technical right to host and display them in order to provide the service. You may delete them at any time; deleting an unlocked file loses its unlock (Article 5).

The data, assumptions, figures and documents you enter are never resold, used for advertising purposes or used to train artificial intelligence models without your explicit consent.

10. Use of the service and account

Access to the service is by authentication with a magic link or through a third-party identity provider such as Google or Microsoft. The user remains responsible for the confidentiality of their account and the security of the related access.

The user undertakes:

to provide accurate information;
not to use the service for unlawful purposes;
not to attempt to circumvent the security measures;
not to share access to their account with third parties improperly;
not to disrupt the operation of the service.

The publisher may suspend or delete an account in the event of a breach of these terms, after a formal notice that has gone unheeded or, in the event of manifest fraud, persistent non-payment or a serious risk to the security of the platform, immediately.

You may request the deletion of your account at contact@bizkick.be. A current subscription is then cancelled; the deletion and its time limits are described in the privacy policy.

11. Availability, changes to the service and liability

Without prejudice to the legal guarantee of conformity (Article 7), the service is provided “as is”, with a high availability objective but without any guarantee of uninterrupted operation. Maintenance may occasionally interrupt the service temporarily; we strive to limit its duration and impact.

BizKick may change its features, interface, calculation methods or prices to improve the service or to respond to legal, tax or technical developments, in compliance with the notification rules of Article 3 for current subscriptions.

The publisher's total liability is limited to the amount actually paid by the user in the twelve months before the event giving rise to the damage and excludes any indirect damage, within the limits of Belgian law. This limitation does not apply in the event of fraud, gross negligence or where the law prohibits it.

12. Applicable law and disputes

Belgian law. Courts of the judicial district of Liège, without prejudice to the mandatory rules protecting consumers. Consumer mediation: Consumer Mediation Service.
